Please read these Terms of Use carefully, together with our Privacy Policy (https://www.redtomatoes.com.sg/Information), before using our website www.redtomatoes.com.sg ("Site") or our Services (defined below), so that you are aware of your legal rights and obligations with respect to Red Tomatoes (S) Pte Ltd ("Red Tomatoes", "we", "our" or "us").

By accessing this Site and/or using the Services, you agree:

(i) that you have read and agree to be legally bound by these Terms of Use; and

(ii) that you are 18 years of age or above, or are using the Site under the supervision of a parent or guardian.

If you do not accept these Terms of Use, please leave the Site and discontinue use of the Services immediately.

Red Tomatoes may at any time vary or amend these Terms of Use by posting the amended Terms of Use on the Site. Any use of the Site or Services after the amendment is deemed acceptance of the amended Terms of Use. If you do not agree to the amended Terms of Use, you may stop using the Site and Services.

1. Site and Services

1.1 The Site is owned and maintained by Red Tomatoes.

1.2 Red Tomatoes operates an online personal care and home care store through the Site, which offers one or more of the following features and services (each a "Service" and collectively the "Services"):

1.2.1 access to information, products, listings, pricing, images and other content;

1.2.2 search tools;

1.2.3 email or message alerts; and

1.2.4 any other services or features that Red Tomatoes may offer through the Site from time to time at our sole discretion.

1.3 Red Tomatoes reserves the right to change, modify, suspend or discontinue the whole or any part of the Services or Site at any time. We may also limit certain features or restrict your access to parts or all of the Services or Site without notice or liability.

2. Licence

2.1 Red Tomatoes grants you a personal, non-exclusive and non-transferable licence to use the Site and the Services available via the Site, subject to these Terms of Use.

2.2 You agree not to reproduce, copy, modify, publish, distribute, sell or otherwise exploit for any commercial or other purpose any part of the Services, the Site, or any information, listings, pricing, images, text or other content made available on or via the Site or Services (collectively, "Content"), except with the prior written consent of Red Tomatoes or as expressly permitted in these Terms of Use.

2.3 You agree not to reproduce, display or provide access to the Site, Services or Content through framing, mirroring, scraping, spidering or any other technological means without the prior written permission of Red Tomatoes.

2.4 The Site and all Content are the copyrighted work of Red Tomatoes or our content or software providers, and Red Tomatoes reserves all rights in the Site and Content.

2.5 You may not hack into, interfere with, disrupt, disable, over-burden or otherwise impair the proper working of the Site, Services or our servers, including through denial-of-service attacks, spoofing, session hacking, tampering or spamming.

3. Account Information

3.1 To access certain parts of the Site or Services, you may be required to register an account with Red Tomatoes ("Account") using your email address and a password.

3.2 You are solely responsible for keeping your login details confidential. You agree not to share your Account or password with others, or transfer your Account to any other person.

3.3 You are responsible for all activity conducted through your Account. Red Tomatoes is not liable for any loss arising from wrongful or fraudulent use of your Account. If you become aware of any unauthorised use of your Account, please notify us promptly at order@redtomatoes.com.sg.

3.4 Each household or delivery address may register only one (1) Account. Multiple Accounts using the same delivery address may be permitted at our sole discretion.

3.5 Please provide accurate, complete and up-to-date Account information. You may update your details at any time through the My Account page.

3.6 Where a delivery address is associated with multiple Accounts without our written authorisation, or fraudulent or wrongful use of an Account is detected or suspected, we reserve the right, at our sole discretion and without liability, to:

3.6.1 cancel any orders placed through such Accounts;

3.6.2 cancel or invalidate any credits, vouchers, coupons or codes awarded to or used by such Accounts;

3.6.3 exclude such Accounts from promotions, contests or surveys; and/or

3.6.4 merge, suspend and/or terminate such Accounts.

4. Pricing, Orders and Payment

4.1 Orders

4.1.1 Every order you place is an offer to purchase the selected products on these Terms of Use. All orders are subject to acceptance by Red Tomatoes. Processing of payment does not in itself mean an order has been accepted. Where an order is rejected or cancelled by Red Tomatoes, any payment made will be refunded.

4.1.2 All orders are subject to stock availability. Red Tomatoes may cancel, amend or reject an order in whole or in part where a product is out of stock, damaged or otherwise unavailable, and will refund any payment made for the affected products.

4.2 Product information and pricing

4.2.1 Red Tomatoes endeavours to provide accurate and up-to-date pricing, product and promotional information, but errors may occasionally occur. We do not guarantee that pricing, images or other product information will be error-free or complete.

4.2.2 If the actual price of an item you ordered is higher than shown on the Site, we will contact you and you may confirm or cancel your purchase of that item at the correct price. If you cancel, we will refund payment for that item. If we are unable to contact you, the order for that item will be treated as cancelled.

4.2.3 All prices are shown in Singapore dollars and include Goods and Services Tax (GST). Prices may change from time to time, and promotions or offers may be withdrawn at any time without notice.

4.3 Payment

4.3.1 Payment for all orders shall be made in Singapore dollars.

4.3.2 We accept payment by MasterCard, Visa, Google Pay and Apple Pay (processed securely through PayPal), PayPal, and PayNow/PayLah!. The payment methods available through PayPal are subject to PayPal's own terms and may change.

4.3.3 By placing an order, you authorise us to carry out verification checks, including card verification, to confirm your identity, protect you and us from fraud, and arrange delivery of your order.

5. Voucher Codes, Promotions and Other Programmes

5.1 From time to time Red Tomatoes may run promotions, contests, surveys and other programmes, which may be subject to additional terms shown on the Site. Those terms form part of these Terms of Use.

5.2 Promotions and programmes are valid only for the period specified by Red Tomatoes.

5.3 The following terms apply to credits, vouchers, coupons and codes ("Voucher Codes"):

5.3.1 Each Voucher Code may be used only once and only within its stated validity period.

5.3.2 Voucher Codes must be applied at checkout. They cannot be applied to an order after it has been placed.

5.3.3 Voucher Codes cannot be combined with any other promotion, voucher or offer, including discounted sale items, unless otherwise stated.

5.3.4 A minimum spend may apply.

5.3.5 Voucher Codes cannot be refunded or exchanged for cash.

5.3.6 Voucher Codes may not be resold, transferred, shared, copied or altered.

5.3.7 Voucher Codes will not be replaced if lost, stolen, duplicated or misused.

5.3.8 Red Tomatoes may verify any Voucher Code and cancel any Voucher Code we believe has been obtained or used fraudulently.

5.4 Where a free gift is offered as part of a promotion, it is offered on a first-come, first-served basis while stocks last. No cash will be offered in place of the gift.

5.5 Red Tomatoes's decision on all matters relating to promotions, discounts and Voucher Codes is final.

5.6 Red Tomatoes may discontinue any promotion, discount, Voucher Code or programme at any time without notice or liability.

6. Delivery

6.1 We deliver to most areas in mainland Singapore through our courier partners, J&T Express and SPX. Some areas may be outside courier coverage, and we will only accept orders for delivery within coverage.

6.2 Delivery fees and estimated delivery times are shown on our Delivery page (https://www.redtomatoes.com.sg/delivery-fee-charges-services). Orders are usually dispatched within 1 working day and delivered 1-3 working days after collection by the courier. These are estimates only. Delivery may be affected by factors outside our control, and Red Tomatoes is not liable for early or delayed deliveries.

6.3 Bulk orders (orders of more than 60 units of any product, unless otherwise agreed in writing) may be subject to a different delivery fee and a longer delivery time. Please contact us at order@redtomatoes.com.sg to place a bulk order.

6.4 Please notify us immediately of any change to your delivery address or contact number. Changes made after an order has been submitted may incur an administrative charge of S$10.00.

6.5 Where you instruct us or the courier to leave your parcel at the door of the delivery address, delivery is at your own risk, and you accept all risk of loss, theft and damage.

6.6 If an order is cancelled after dispatch, or delivery fails because no one is available to receive it, Red Tomatoes may reschedule or cancel the delivery and charge a re-delivery or cancellation fee of S$10.00.

7. Returns and Refunds

7.1 If you receive a damaged, defective, wrong or missing item, please report it within 1 working day of receipt, as set out in our Returns & Refunds Policy (https://www.redtomatoes.com.sg/returns-policy), which forms part of these Terms of Use.

7.2 Where a returned product was purchased under a promotion or discount, you will be refunded only the amount you actually paid for it. Where a discount applied to the whole order, the refund will be the product's selling price less its pro-rated share of the discount. Any free gift given with a returned product must also be returned.

8. Intellectual Property

8.1 All copyright, trade marks, designs and other intellectual property rights in the Services, the Site and all Content belong to Red Tomatoes and its licensors.

8.2 The trade marks, logos and brand names ("Marks") displayed on the Site belong to Red Tomatoes or the respective brand owners. You may not use the Red Tomatoes name or any Marks, including in advertising or as a hyperlink, without prior written consent from Red Tomatoes or the relevant owner.

8.3 The domain name of the Site belongs to Red Tomatoes, and you may not use or adopt a similar name for your own use.

9. Feedback and Comments

9.1 You may submit comments, feedback and suggestions ("Comments") provided they are not illegal, offensive, defamatory, abusive, infringing or otherwise inappropriate, and do not contain viruses or spam. You may not use a false email address or impersonate any person. Red Tomatoes may review, edit or remove any Comments.

9.2 You grant Red Tomatoes a non-exclusive, royalty-free, perpetual and irrevocable licence to use, reproduce, adapt, publish and distribute any Comments you submit, for any purpose, and agree that we may publish your name with them.

10. Limitations and Disclaimers

10.1 While we make every effort to keep the Site, Services and Content accurate and complete, they are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Red Tomatoes disclaims all warranties, express or implied, including warranties of satisfactory quality, fitness for a particular purpose and non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free or free of viruses or other harmful components.

10.2 You agree that Red Tomatoes may at any time, without prior notice, add to, vary, suspend or withdraw any part of the Site or Services, and that access to the Site or Services may from time to time be interrupted or affected by technical problems. Red Tomatoes is not liable for any loss arising from such events.

10.3 To the fullest extent permitted by law, Red Tomatoes is not liable for any damages, losses or expenses arising from the use of, or inability to use, the Site, Services or Content. If Red Tomatoes is nevertheless found liable, our total liability to you:

10.3.1 for any order, sale or delivery of a product shall not exceed the price of that product; and

10.3.2 in all other cases shall not exceed S$1.

10.4 To the fullest extent permitted by law, Red Tomatoes is not liable for any indirect, special, consequential or incidental damages arising from the Site, Services or Content.

10.5 Nothing in these Terms of Use limits any rights you have as a consumer that cannot be excluded under Singapore law.

11. Linked Sites

11.1 The Site may contain links to other websites ("Linked Sites"), such as our courier partners' tracking pages. Red Tomatoes has no control over and is not responsible for the content, availability or security of Linked Sites, and does not endorse them. Your use of Linked Sites is at your own risk.

12. Termination and Suspension

12.1 Red Tomatoes may, at its sole discretion and without notice or liability, restrict, suspend or terminate your access to all or part of the Site or Services, and/or suspend, deactivate or delete your Account.

12.2 Without limiting the above, Red Tomatoes may deactivate your Account if it has been inactive for 10 years or more, or if you breach these Terms of Use.

13. Privacy

13.1 Red Tomatoes recognises the importance of keeping your personal information secure and private. Please read our Privacy Policy (https://www.redtomatoes.com.sg/Information) to understand how we collect, use and protect your personal data, and read it before submitting any personal information.

14. Notification of Infringement

14.1 If you believe your work has been used on the Site in a way that infringes your copyright or other intellectual property rights, please notify Red Tomatoes in writing with the information required under the Singapore Copyright Act 2021 ("Infringement Notice").

14.2 Infringement Notices should be sent to:

14.3 Red Tomatoes will consider all Infringement Notices and take appropriate action. You agree not to take legal action against Red Tomatoes in respect of any allegedly infringing material without first sending an Infringement Notice and giving us a reasonable opportunity to remove it.

14.4 Red Tomatoes is not responsible for infringing material on Linked Sites or other third-party sites.

15. Jurisdiction

15.1 The Site and Services are intended for residents of Singapore only. Red Tomatoes makes no representation that they are appropriate or available for use elsewhere. Anyone accessing the Site from outside Singapore does so on their own initiative and is responsible for complying with local laws.

16. Indemnity

16.1 You agree to indemnify Red Tomatoes and its officers, agents, partners and employees against all claims, liabilities, penalties, losses and costs (including legal costs) arising from:

16.1.1 your use of the Site or Services;

16.1.2 your breach of these Terms of Use;

16.1.3 your violation of the rights of any other person; or

16.1.4 your breach of any law.

17. Severability

17.1 If any provision of these Terms of Use is found to be illegal, void or unenforceable, the remaining provisions shall continue in full force and effect.

18. Governing Law

18.1 These Terms of Use are governed by the laws of Singapore.

18.2 You agree to submit to the non-exclusive jurisdiction of the Singapore courts.

19. Relationship of Parties

19.1 Nothing in these Terms of Use creates an agency, partnership or joint venture between Red Tomatoes and you.

20. Waiver

20.1 No waiver by Red Tomatoes of any right is effective unless made in writing and signed by an authorised representative of Red Tomatoes. A failure to enforce any right is not a waiver of that right.

21. Force Majeure

21.1 Neither party is liable for any failure to perform its obligations under these Terms of Use caused by events beyond its reasonable control, including strikes, civil unrest, war, terrorism, government action, telecommunication or power failures, fire, flood, natural disasters, epidemics, quarantine restrictions, supply disruptions or transport failures. The affected party will resume performance as soon as reasonably possible.
